Terms of Service and Privacy Policy

Tibidabo Company ("we" or "us") provides an own developed, interactive, flash streaming Application that enable the sharing of live video and audio content via the Internet. The app include Tibidabo's proprietary embeddable video player, the description to use the player related technology (including any updates, new versions or new releases).

Please read the following Terms of Service carefully. These are a legal agreement between you and Tibidabo and apply to you if you are a Client (defined below).

This is a License Agreement and not an agreement for sale. Subject to the terms and conditions of this Agreement, Tibidabo grants only the right to use the Licensed Application.

YOU UNDERSTAND THAT BY USING THIS WEBSITE, YOU ARE AGREEING TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE IN THEIR ENTIRETY, YOU MAY NOT USE THIS APPLICATION

1. Registration.

In order to test and use the Application you will have to create an account and become a "Client". To become a Client you must be at least 18 years of age.

When you register you will be asked to choose a username and a password. You are responsible for safeguarding your password and you agree not to disclose your password to any third party. You agree that you will be solely responsible for any activities or actions taken under your password, whether or not you have authorized such activities or actions. You should immediately notify Tibidabo of any unauthorized use of your password. You agree that the information that you provide to us upon registration will be true, accurate, current and complete. You may not use false identities or impersonate any other person or use a username or password that you are not authorized to use. Tibidabo reserves the right to require you to change your username for any reason and may do so at anytime.

Tibidabo reserves the right, at its sole discretion, to modify, discontinue or terminate providing the Application, or to modify these Terms of Service at any time and without advance notice. However, changes made to these Terms of Service will not apply to you to the extent that

a./ the changes concern matters which are the subject of an actual dispute between you and Tibidabo as of the date the changes take effect and

b./ Tibidabo has actual notice of the dispute as of the date the changes take effect. If we modify these Terms of Service, we will post the modification on the Site or within the Services or provide you with notice of the modification.

You may terminate your account at any time and for any reason.

After any termination, you understand and acknowledge that we will have no further obligation to provide the Services. Upon termination, all licenses and other rights granted to you by these Terms of Service will immediately cease.

2. Fees and payment.

In order to use the paid version of the Services, you will be required to provide your billing and account information ("Billing Information") for a credit card, payment card or another payment system, such as PayPal, for which you are authorized to approve charges (each, a "Payment Source") to allow Tibidabo Partner to collect payment from you for your use of the Services. You must provide true, accurate, current and complete Billing Information and maintain and promptly update your Billing Information to keep it true, accurate, current and complete.

You authorize Tibidabo's Partner to automatically and immediately bill your Payment Source when charges for your use of the Application are due, without any further action on your part or other prior notice on the part of Tibidabo. You assume full responsibility for such charges, even if such charges are declined or not paid by your Payment Source.

If your Payment Source is invalid, if charges billed to your Payment Source are declined or not paid or if you fail to pay charges for the Application when due, your account may be suspended or cancelled at Tibidabo's discretion. If your account is suspended, Tibidabo may, but is not obligated to, maintain your account and/or related content and information, in order to allow you pay the past-due charges and restore your account. If the charges are not paid, your account may be cancelled.

All fees are non-refundable. Transactions you complete through the Tibidabo's Partner may include sales tax based on the bill-to address and the applicable sales tax rate in effect at the time and location your transaction is completed. You will be responsible for, and will promptly pay, all taxes and duties of any kind.

2.1. Tibidabo Partner

The subscriptions for the Application developed by Tibidabo is managed by Saasy.com e-commerce company.

2.2 Tibidabo Servers

For serving our Clients as best as possible, we utilize two different servers for powering our Application. One in USA serving all Clients from USA/Canada, another one within EU serving all Clients from Europe.

We offer our Clients the usual 99%+ uptime guarantee, not included the DDOS attack cases to our servers which are outside from our responsability. If our client server is being DDOSed, the IP is made unreachable with IP nullroute. It will stay unreachable (minimum 24 hours) until DDOS stopped.

3. Application License.

Tibidabo grants you limited, non-exclusive, non-transferable license, without the right to sublicense, and install a copy of the Application for a third person or company. You may not copy or modify the Application, including, but not limited to adding new features or otherwise making adaptations that alter the functioning of the Application. It's strictly prohibited to transfer, resell, rent, lease, distribute, sublicense or otherwise assign any rights to, or any portion of the Application to any third party. The Application contains trade secrets and in order to protect them you agree not to disassemble, decompile or reverse engineer the Application, in whole or in part, or permit or authorize a third party to do so.

The Application may be used and accessed for lawful purposes only. You agree to abide by all applicable local, state, national and foreign laws, treatises and regulations in connection with your use of the Application.

4. Feedback and Communication

You may submit feedback by emailing us at trustotal@trustotal.com . You agree, however, that if you elect to provide suggestions, ideas, proposals, concepts or other feedback to us, you acknowledge and agree that we have no obligation (whether of confidentiality, compensation or otherwise) with respect to such feedback and we will be free to use and exploit the same in any manner without restriction of any kind. You acknowledge and agree that all feedback will be the sole and exclusive property of Tibidabo.

Privacy policy contains information about our policies and procedures regarding the collection, use and disclosure of information we receive from Tibidabo Clients.

contact information including name, email address and Skype ID-s.
demographic information such as country, postcode.

What we do with the information we gather

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

Internal record keeping.
We may use the information to improve our products and services.
We may contact you by Skype or e-mail.

Security

We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

We will NOT sell, distribute or lease your personal information to third parties.
